Focus and Scope

Precedente is the legal journal of the School of Human Sciences at Icesi University in Cali, Colombia, issued twice a year. This journal gathers unpublished works of local and foreign scholars who focus on legal history, comparative law, legal theory, and legal dogmatics in civil, commercial, labor, constitutional, administrative, criminal law, among others. Due to the reflective, critical, and constructive nature of the articles, recensions and reviews that published the Journal, Precedente’s primary objective is to divulge and disseminate its authors’ research, to the point of making them a fundamental source for future scholarship, as well as the basis of rational deliberation. Precedente is a free and open access scholarly journal published to the legal global community.

Using a peer-reviewed editorial process that ensures anonymity throughout the entire publication process, Precedente guarantees not only a high-quality selection process, but also useful articles that respond to the needs and expectations of the legal community. Precedente is issued at the end of January and July every year.

Peer Review Process

The Precedente Editorial Committee has established a double-blind review process for the articles it receives for consideration. Upon receiving an article, the Editorial Committee evaluates its academic relevance and compliance with the editorial standards established by the journal. Then, he proceeds to contact two academic peers who are experts on the subject to assess its originality, topicality of the bibliography, mastery of the bibliography, clarity in the argumentation, quality of the writing, scientific quality of the article, and the importance and relevance of the subject. In case of controversy, additional arbitrations will be requested from one or more peer reviewers.
 
The evaluation process usually takes two to four months. However, delays may occur if one or more reviewers do not fulfill their review commitment, or if a dispute arises that requires the search for additional referees.
 
Based on the concept of peer reviewers, the journal's Editorial Committee makes the final decision to deny or approve –with or without modifications– the publication of the article. When modifications are suggested to the author, he must incorporate them within a period of no more than 4 weeks. Throughout the process, the Editorial Committee will ensure the anonymity of the peer reviewers and the author. The decision taken by the Editorial Committee about the publication of the article is unobjectionable. The Editorial Committee, or failing that, the Editorial Coordinator of the publication, will be in charge of informing the authors in a timely manner of the evaluation process of the articles and the decisions taken in this regard.

Open access policy

This journal provides immediate free access to its content under the principle of making research freely available to the public, which fosters a greater global knowledge exchange. The journal is distributed under the Creative Commons license Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0).

Electronic backup and preservation of access to journal content

From the perspective of information security, critical information from the University is backed up, which includes the journal information repository. Backups are performed daily and are protected with AES-256 encryption. Additionally, the journal deposits its published content in the PKP Preservation Network through the PKP PN plugin.

Other considerations

Precedente does not charge for publishing or submitting articles in the editorial process of the Journal. As an editorial practice, it asks the authors who present articles or have published in the journal, if they will be willing to evaluate a future article if required. The journal also does not pay fees to its reviewers.
 
In the process of style review, the journal reserves the right to make small adjustments in the titles of the articles, as well as minor corrections in the writing, in the translations, as well as in the Resúmenes and Abstracts; although the general policy to be followed will be to consult the authors on these issues.
 
Precedente uses Turnitin software to detect non-original content in manuscripts. By submitting your manuscript to this journal you are also agreeing to any originality tests that your manuscript may have to undergo during the production and peer review processes.
