Hernán Velásquez, profesor de la Universidad de Medellín, fue despedido unilateralmente. La Corte Constitucional, en resolvió amparar sus derechos al debido proceso, a la defensa y a la dignidad humana, pues su despido ocurrió después de que manifestara públicamente su rechazo a las reformas que estaba adoptando la rectoría de la universidad

Hechos del caso:

Hernán Velásquez presentó acción de tutela contra la Universidad de Medellín, institución que lo despidió el 19 de febrero de 1998 por manifestarse de forma pública, abierta y pacífica en contra de la administración y la rectoría de la universidad. Dicha manifestación estuvo relacionada con la renuncia de Juan Carlos Gaviria Gómez y con las reformas efectuadas por la rectoría de la universidad relativas a la contratación de docentes hora cátedra, los cuales tenían —según Hernán Velásquez— dudosa calidad ética. Producto de la oposición de Hernán a estas reformas, la universidad decidió despedirlo de manera unilateral, sin ser llamado a descargos, sin ser oído ni poder oponerse.

El caso fue revisado por la Corte Constitucional, la cual, en Sentencia SU-667 de 1998, resolvió la siguiente pregunta:

¿El despido realizado por la administración de la Universidad de Medellín es válido legalmente o, por el contrario, no se garantizaron los derechos al debido proceso, la defensa y la dignidad humana de Hernán Velásquez?

Argumentos y decisión:

El juez de primera instancia, en el trámite de tutela, señaló que el despido está amparado en el principio de autonomía universitaria. En consecuencia, los despidos no tienen que seguir ningún procedimiento establecido. La Corte estuvo en desacuerdo con esta interpretación y señaló que el despido, así como los procesos disciplinarios, deben permitir que la persona sea escuchada y pueda presentar oposición.

Adujo la Corte que los despidos unilaterales que sean arbitrarios, no se hagan con justa causa o se realicen con coacción o limitación de un derecho fundamental son contrarios a la ley y, por lo tanto, suponen una extralimitación de los derechos de los empleadores. El contrario laboral debe ceñirse a lo permitido por la ley, y jamás puede eliminar, subrogar o erradicar los derechos fundamentales a la libertad de expresión o al libre desarrollo de la personalidad.
